All our activities are subject to the Dutch Freight Forwarding Conditions (FENEX conditions), filed with the Amsterdam, Arnhem, Breda and Rotterdam District Court (latest version), including the arbitration clause included therein (Article 23 FENEX conditions). We will send it free of charge upon your first request.
What are the FENEX conditions?
The FENEX conditions are the general terms and conditions applicable to freight forwarders in the Netherlands. These conditions are established by the Dutch industry association for forwarding and logistics and are widely applied within the sector. The conditions govern the rights and obligations of both the freight forwarder and the client in the arrangement of transport and logistics services.
Key provisions
The FENEX conditions contain provisions regarding liability, insurance obligations, payment terms and dispute resolution. Article 23 contains an arbitration clause, which means that disputes are submitted to an arbitration committee rather than a regular court. This ensures specialized and efficient handling of any disagreements.
Applicability
These conditions apply to all assignments you provide to Sevenhills Logistics. This applies to all forms of transport we arrange, including sea freight, air freight, road transport, rail transport and warehousing. By providing an assignment to us, you agree to the applicability of these conditions.
